Food safety remains an issue of significant public and government concern in China going into the new calendar year and the impending Chinese New Year. High profile food safety scandals, including contaminated meat and pet food, continued in China over the last two years, further eroding the public’s confidence in some domestically processed foods.
As a result of the increased scrutiny of the food system, in December 2014, China’s National People’s Congress (NPC) released a second proposed draft of the Food Safety for public comment (Second Draft FSL). The comment period closed on January 19, 2015. The FSL is the centerpiece of China’s food regulatory regime.
The Second Draft FSL reflects NPC revisions made in response to comments by NPC delegates, administrative agencies in China, and other stakeholders on an earlier draft released in July of 2014. The NPC will resume consideration of the FSL now that it has collected a second round of comments. It is difficult to predict when the NPC will finalize the law. For the prior revision in 2009, it took approximately two years for the NPC to complete its review.
The Second Draft FSL makes several changes that will be significant to all food and dietary supplement companies doing business in China.
