NEW YORK CITY - A New York State judge has issued an injunction against New York Mayor Michael Bloomberg's ban on the sale of large sugary drinks at New York City restaurants and other locations, the Wall Street Journal reports.
Judge Milton Tingling ruled that the drink regulations were "fraught with arbitrary and capricious consequences" that would be difficult to enforce. The National Center for Public Policy Research released a statement praising the ruling.
"Judge Tingling's ruling makes it clear that Mayor Bloomberg overstepped his authority and should have either left this issue to the state legislature or the New York City Council," said Horace Cooper, a legal commentator for the Center.
Meanwhile, Yahoo News reports that while the ban may have been overturned, many businesses were already following the rule.
Bloomberg has said the city will appeal the ruling, arguing the ban is necessary to help combat obesity among NYC residents, according to Yahoo.
